3.0   AGENDA REVIEW / RESIDENT REQUESTS – none.

 

4.0   APPROVAL OF MINUTES –
Motion by Rugar, seconded by Rutherford, to approve minutes from 7/20/04 Board meeting. Motion passes 3-0-1 (Busman abstains). Motion by Rugar, seconded by Rutherford, to approve amended minutes from 8/24/04 Board meeting. Motion passes 3-0-1 (Busman abstains). Motion by Rugar, seconded by Rutherford, to approve minutes from 11/9/04 and 11/16/04 Board meeting. Motion passes. Action on minutes from 9/21/04 and 11/4/04 meetings deferred.

 

5.0   REPORTS

       5.01   FINANCIAL REPORTS – Rick Busman reports four payments were made to Ekim Painting, approximately $104,000 to date with $27,000 remaining to be billed. $600 was paid to SunRain, $624 paid on #110, and $680 to Roberts Tree Service for two tree removals. Rutherford notes we appear to be $2900 over budget in category 7600 but some of these items (e.g., Dennis Sullivan) are really Section 1 work and should be placed in that category.

       5.02   WELCOMING REPORT – Jack Rugar reports no new move-ins.

       5.03   WEBSITE REPORT – Glen Grossman. No report.

       5.04   GARDENING REPORT – Rodger Axt submitted a written report (see attached) and gave an oral summary. Property Services now has current general liability insurance. Property Services has deferred its rate increase to 9/1/05 to coordinate with the start of The Glen’s fiscal year. One other bid has been submitted to the Committee. The Committee will be holding a meeting to discuss the lake on 1/22/05 at 10:00 a.m. at #13 Glen Lake Drive. Rutherford’s presence is requested.

       5.05   RULE COMPLIANCE REPORT – Jack Rugar advises he has left messages for Diane Hardcastle regarding tenant parking sideways in drive way of #65.

       5.07   MAINTENANCE REPORT – Jack Rutherford reports there is debris behind #17. Candy Pollock advises the trench behind #110 needs dirt. Rugar advises the bank of the lake behind #110 is broken. Rutherford to call Granite Construction to check on the bank.

       5.08   LAKE REPORT – Jack Rutherford. No report.

       5.09   WILDLIFE CONTROL REPORT – Jack Rugar. One new raccoon caught and one trap removed.

       5.10   ARCHITECTURAL CONTROL REPORT – Ken Morley reports the Architectural Control Committee recommends amending Rule J of the Rules and Regs by adding after the first full paragraph:

            “Existing metal garage doors, which do not require painting, are approved as to color and design as they exist in December 2004. Existing wooden garage doors will be painted by the Association as necessary.
An ACC request must be submitted whenever an owner wishes to replace a garage door. The new door will conform in color and design to existing doors. It is intended that the color of the new door match any adjacent door.”

            Motion by Grossman, seconded by Rugar, to amend the Rules and Regulations of The Glen of Pacific Grove Homeowners’ Association by adding after the first paragraph in Rule J, “Approval of the ACC is required when anyone wants to paint or replace a garage door.” Motion passes. Motion by Grossman, seconded by Rutherford, that the colors of the garage doors shall be determined by the ACC. Motion passes.

       5.11   AD HOC COMMITTEES – Jack Rugar
 a.   Document Revision – Glen Grossman. Deferred.
 b.   Finance Review – Rick Busman. No report.

       5.12   NEWSLETTER ITEMS:

·        Publish new amendment to Rule J.

·        Someone checks the raccoon traps daily and any raccoon caught is removed within 24 hours. If you find something in a trap, please call the Glen phone # 642-2441.

·        Anyone interested in volunteering to serve on the Rules Enforcement Committee.

 

6.0   UNFINISHED BUSINESS

        6.01   TV Bulk Rates – Candy Pollock. Deferred.

        6.02   Painting – Jack Rugar. Ekim Painting has done all the base painting. Trim work and highlight color remains to do. Ekim is now working with a two-man crew. They will distribute a form so each owner can note problems. Trim work may be finished next week. Front doors will probably be done in the spring.
Chimneys have been sealed. Rugar recommends doing nothing substantive to the chimneys until the roofs are replaced (in 2008 or 2009).
One owner does not want a highlight color. The “sense” of the Board is that everyone is required to have a highlight color.
Rugar is still trying to obtain Ekim’s signature on the Amended Contract signed by Grossman.

        6.03   Rules for Renting – deferred to 7.01.

        6.04   Election Issues – resolved.

        6.05   Painting of Garage Doors - done

 

7.0   NEW BUSINESS –

        7.01  New CC&Rs & bylaws – Diana Busman. Busman reports John Garvic, the attorney the Association intends to hire to redraft CC&Rs, is ill and may need surgery. The Board’s preference is to meet with him on a Saturday afternoon, perhaps in San Jose to save the Association money.

        7.02   Resurrection of the Rules Enforcement Committee – place an ad in the Glen Gazette to see if anyone is interested in volunteering.

        7.03   Glen Heights & Gates Tree Service illegally topping trees on The Glen property. – Rodger Axt reports he notified Pete Passanini (sp?) and Gates Tree Service not to trespass onto The Glen property in order to top our trees.

 

8.0   CORRESPONDENCE
8.01 Letter from Chuck Adams regarding furniture, shopping carts, moving vans, and truck campers on Moreland Drive. MCC will write to the City of Pacific Grove requesting the City to amend its zoning laws to prohibit parking commercial vehicles overnight on Moreland.

            8.02 Letter from AJ Louis advising that he believes the Board cannot regulate renting and requesting notice of when the Board discusses regulating rental activity so he can be present. It is noted that Mr. Louis is neither an owner nor a tenant.          

 

9.0   FUTURE BOARD MEETING / ADJOURNMENT – 1/18/05 at 6:00 p.m. at 71 Glen Lake Drive.
